Terms of Use

These Terms of Use ("Terms") govern your use of the Overstay iOS application ("the app") developed by Thomas Wright ("we," "us," or "our"). By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the app.

1. Description of the App

Overstay is a personal travel tracking tool that helps users monitor time spent in foreign countries, calculate visa and immigration allowance usage, and plan future trips. The app operates entirely on your device — there are no user accounts, no server-side processing, and no remote data storage beyond the optional encrypted iCloud backup feature.

2. Not Legal, Immigration, or Tax Advice

This is the most important section of these Terms.

Overstay provides calculations, reference information, and planning tools to help you understand your travel history and visa situation. The app does not provide legal, immigration, or tax advice. Specifically:

• Visa rules, stay limits, and allowance calculations displayed in the app are for informational purposes only and may not reflect the most current regulations.
• Bundled visa rule data is updated periodically with app releases but may be out of date at any given time.
• Custom allowance rules are defined entirely by you. We do not verify that any custom rule matches an official visa, immigration, or tax requirement.
• The Trip Planner's what-if calculations are estimates based on the data you have entered. They do not account for rules or conditions not modelled in the app.
• No output of the app — including dashboard gauges, calendar views, notifications, or PDF/CSV exports — should be treated as legal certification or official documentation of your immigration status.

You are solely responsible for verifying your visa and immigration obligations with official government sources, qualified legal counsel, or licensed immigration advisors before making travel or residency decisions.

We accept no liability for fines, re-entry bans, rejected applications, tax liabilities, or any other consequences arising from reliance on the app's calculations or data.

3. Eligibility

The app is available to anyone aged 4 and above as rated on the App Store. No account or registration is required.

4. Your Data and Responsibilities

All data you enter into the app — including trips, nationality, preferences, and allowance rules — is stored locally on your device. You are responsible for the accuracy of the data you enter. The app's calculations are only as accurate as the information you provide.

If you enable iCloud backup, your data is encrypted on your device and stored in your personal CloudKit private database. We cannot access, read, or recover this data. If you lose access to your Apple ID and all enrolled devices, your backup will be permanently unrecoverable. See our Privacy Policy for full details.

5. Subscriptions and Purchases

Pricing and Billing

Overstay offers premium features through in-app purchases processed entirely by Apple:

• Annual Subscription: Provides access to all premium features for one year from the date of purchase.
• Lifetime Purchase: A one-time payment that provides permanent access to all current and future premium features.

All prices are displayed in your local currency in the app and are set via Apple's App Store pricing. Pricing may vary by region and is subject to change.

Auto-Renewal

The annual subscription automatically renews unless you turn off auto-renewal at least 24 hours before the end of the current subscription period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

Managing and Cancelling Subscriptions

You can manage or cancel your subscription at any time through your Apple ID account settings:

1. Open the Settings app on your device
2. Tap your name at the top
3. Tap Subscriptions
4. Select Overstay
5. Tap Cancel Subscription

Cancellation takes effect at the end of the current billing period. You retain access to premium features until that date. No partial refunds are provided for unused portions of a subscription period.

Free Trial

If a free trial is offered, it will be clearly stated on the purchase screen along with its duration. The trial converts to a paid subscription automatically at the end of the trial period unless you cancel at least 24 hours before the trial expires. Any unused portion of a free trial is forfeited upon purchasing a subscription.

Refunds

All purchases are processed by Apple. Refund requests must be directed to Apple through their Report a Problem page at reportaproblem.apple.com. We do not process refunds directly.

Restoration

If you change devices or reinstall the app, you can restore your purchases using the "Restore Purchases" option in the app's Profile settings. This is handled by Apple's StoreKit framework using your Apple ID.

6. Acceptable Use

You agree to use the app for its intended purpose as a personal travel tracking and planning tool. You agree not to:

• Reverse engineer, decompile, or disassemble the app
• Redistribute, sublicense, or resell the app or any of its content
• Use the app's bundled visa rule data to build a competing product or service
• Misrepresent the app's outputs as official government documentation or certified legal records
• Use the app's export features to create fraudulent or misleading records

7. Intellectual Property

The app, including its design, code, bundled data, icons, and documentation, is the property of Thomas Wright and is protected by copyright and intellectual property laws. Your purchase or subscription grants you a personal, non-transferable, non-exclusive licence to use the app on devices you own or control, in accordance with Apple's Licensed Application End User Licence Agreement (EULA).

Country boundary data used in the app is sourced from Natural Earth and is in the public domain.

8. Accuracy and Availability

We make reasonable efforts to ensure the app functions correctly and that bundled visa rule data is accurate at the time of each release. However, we do not guarantee that:

• The app will be free from errors, bugs, or interruptions
• Calculations will be correct in every scenario or edge case
• Visa rule data will be current at any given time
• The app will be compatible with all future versions of iOS
• Apple's services (iCloud, CloudKit, StoreKit, MapKit) will be continuously available

We may release updates to fix issues, improve functionality, or update visa data. We are under no obligation to maintain, update, or support the app indefinitely.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the app. This includes, without limitation:

• Fines, penalties, or re-entry bans resulting from immigration non-compliance
• Rejected visa, residency, or citizenship applications
• Tax liabilities arising from incorrect day counting
• Loss of data due to device failure, iCloud issues, or unrecoverable encrypted backups
• Any decisions made in reliance on the app's calculations, notifications, or reference data

Our total liability for any claim arising from these Terms or your use of the app shall not exceed the amount you paid for the app or subscription in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the app, your violation of these Terms, or your reliance on the app for immigration, visa, tax, or residency decisions.

11. Termination

You may stop using the app at any time by deleting it from your device. We reserve the right to discontinue the app or any of its features at any time without prior notice. If we discontinue the app, active subscriptions will not be renewed and no further charges will be applied, but previously charged subscription fees are non-refundable.

12. Apple's Standard EULA

In addition to these Terms, your use of the app is subject to Apple's Licensed Application End User Licence Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula. In the event of a conflict between these Terms and Apple's EULA, Apple's EULA takes precedence to the extent required.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Kingdom, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

14. Changes to These Terms

We may update these Terms from time to time. The revised version will be posted at this URL with an updated date. Your continued use of the app after changes are posted constitutes acceptance of the revised Terms. If we make material changes, we will make reasonable efforts to notify you through the app or its App Store listing.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
